Thanks for reading my article in the recent edition of the Pocono Business Journal. Feel free to post any questions and I’ll get back to you shortly.
A few years ago, I was representing a local company in a domain-name dispute with a major international business. The local company had a web site which provided information about some of the products offered by the “big business”. It wasn’t a derogatory site, nor did it sell competing product, it just provided helpful information about the product. But the big company didn’t want my client using their product name in the URL of the site.
In the course of the litigation, the big company’s big-city lawyers submitted an affidavit with several hundred pages as exhibits — purportedly to show that my client was taking material from dozens of other websites and posting them on the site in dispute.
It turned out that it was those dozens of other websites who had actually stolen material from my client, without my client having a clue about the theft.
This is not an unusual occurrence. Material is easy to copy from the web and can be uploaded to a competitor’s site in a matter of minutes or, even, seconds. And, the theft doesn’t leave any figerprints or trigger any alarms.
Unfortunately, many website owners fail to adequately protect their on-line property. Material which you create and post on your site is yours, and it is valuable (else, why would you post it and why would your competition steal it?). Read the rest of this entry »

I would like to thank the Pocono Business Journal, and the editor Marynell, for the opportunity to contribute about Winning Teams. I am honored to be able to write about teams to the readers of the Pocono Business Journal. It is a topic that I am passionate about as it is so important in increasing the success level of a business
I would like to continue the team building discussion on this web log. I welcome your comments about the PBJ article, or other points/questions you have about employees and teams.
It takes many things to run a successful business; a good product, a good service, a great location, good financing, good professional services from an attorney, accoutant, coach, etc, etc. The one thing that is most often overlooked is the team. However, unless you are a one person company, a great team is critical to your business success.
Team development is an important process while you are running and building your company; getting the right team members on board, improving the team members you currently have, and getting the most performance out of your team. A great team will make your job easy. A great team will delight your customers.
While there are no magic silver bullets, there are many time proven techniques for team building success.
What have you tried that has been successful?
What hiring techniques have proven to be the best for you?
Does your team need to be improved?

I am honored that Marynell has asked me to participate in her fine publication and that she has offered me “blogging rights”. My goal with this blog is to try to bring you news and information on legal matters in a way helpful to your business. I would be very happy to entertain suggestions on topics to cover here or in my published column, as well your business law questions.
What is a Business Lawyer? Well, a Business Lawyer is more than one person — even if it is a single individual. Sure, your Business Lawyer will prepare your contracts, handle your business litigation, collect debts owed to your business. But a solid Business Lawyer can be more than that — a good Business Lawyer can help you navigate through the sometimes rough waters of the business world. A well-trained Business Lawyer puts as much emphasis on anticipating potential legal issues or stumbling blocks and engaging in some preventive measures to help you avoid them.
At least in my Firm, we do not view our purpose to be your “hired gun”. (Not that there’s anything wrong with that!) To us, the hired gun approach suggests a more transitory, Read the rest of this entry »
